Upon appeal to the district court, a decision by a magistrate to award custody of a minor child to Robert Roeh in a divorce action was held to be in error. The district court found that the magistrate relied on evidence too remote in time to be relevant in determining the best interests of the child. The district court set aside the custody award and remanded the case to the magistrate for further proceedings. Mr. Roeh appeals from the district courts decision. We affirm.
